Samir Farajallah’s firm AdvanFort [NEW-FIELDS], was detected moving in Indian waters under the Sierra Leone flag and detained at Tuticorin port in Tamil Nadu. Indian officers recovered 35 assault rifles and 5,724 rounds of ammunition from the vessel. The National Investigation Agency (NIA) is trying to establish if these armaments were intended for the dormant LTTE extremists or Islamic terrorist groups in south India.

Manila, Philippines – A recent raid conducted by the Anti-Fraud and Commercial Crimes Division (AFCCD) of the Philippine National Police’s Criminal Investigation and Detection Group (PNP-CIDG) against a business establishment in Ortigas Center, Pasig City, resulted in the seizure of more than 5.4 million pesos worth of pirated and unlicensed software.

The raid stemmed from a complaint filed by the Business Software Alliance (BSA) on behalf of its members. New-Fields (Asia Pacific), Inc. was reported to the hotline of the BSA for allegedly utilizing computers with unlicensed and pirated software belonging to BSA members.

“New Fields is in the business of organizing corporate events that promotes best practices in business. It is unfortunate that they themselves were caught in this situation of conducting business in an unlawful manner by using unlicensed and pirated software,” said PSSupt. Edgar Danao, chief of the PNP-CIDG-AFCCD.

Armed with search warrant issued by Manila RTC Executive Judge Amor V. Reyes, police officers checked on all computers found in New-Fields’ office at the 16th Floor of Philippine Stock Exchange (PSE) East Tower, Ortigas Center, Pasig City. They found 83 computers loaded with unlicensed copies of different versions of Adobe and Microsoft software. Pirated CD installers containing counterfeit copies of various software programs belonging to Microsoft Corporation were also seized by the raiding team.

The PNP raid is part of the ongoing crackdown campaign of the Pilipinas Anti-Piracy Team (PAPT) to establish software piracy-free zones across the archipelago. The PAPT is a government led-initiative which aims to curb software piracy in the country through the coordinated efforts of the National Bureau of Investigation, Optical Media Board and PNP.

Since the start of 2010, the PAPT has already conducted 20 raids against business establishments involved in the use and sale of pirated and unlicensed software and has seized computers loaded with pirated and unlicensed software as well as pirated software installers amounting to more than 67 million pesos. Nine (9) of these raids were in Makati, five (5) were in Pasig, three (3) were in Quezon City and three (3) were in Rizal province.

The use and sale of pirated and unlicensed software is a violation of the Intellectual Property Code of the Philippines carries a fine of up to P1.5 million and imprisonment of up to 9 years.

As part of its support to the PAPT, the BSA offers a reward of up to 1 million pesos for substantive reports on businesses suspected of using unlicensed software. Software piracy reports can be lodged through the BSA hotline, (02) 895-6438 and 1-800-10-BSA-HTLN (1-800-10-272-4856, toll free).

The PAPT has also declared a 20-day grace period to give time for businesses in Cebu to legalize their use of software before the crackdown operations start in the area. The countdown started on June 1, 2010 and will end on June 28, 2010. PAPT enforcement actions in Cebu will resume on June 29, 2010.

Look at the entries for IP address 65.90.251.169. Notice something peculiar? That’s a hacker trying to inject malicious code into my pages. He was trying to call to code contained in a text file by the name ide.txt located on a possibly compromised domain.

First, I checked out his domain, new-fields.com. It looked legitimate. The text file was another story altogether. Have a look at the screenshot. I also saved the code to my computer in case it ends up disappearing from the Farajallah’s website.

Embassy of the USA in Sri Lanka informed about the illegal activities of AdvanFort

ADVANFORT LIED TO GOVERNMENT OF SRI LANKA

The statement from Avant Garde Maritime Services:

Dear All,

It is observed that information have been disseminated to Private Maritime Security Companies by AdvanFort International, Inc. to the effect that Sri Lankan Waters are unsafe for Seafarers.

This information is totally false and malicious, intended to mislead the Maritime community.

It is pertinent to mention that due to a series of illegal activities conducted by AdvanFort, this company is facing litigation and their vessel ‘MV Seaman Guard Ohio’ is presently in the custody of Indian authorities for conducting illegal Maritime operations (conducting illegal fuelling) and carrying illegal weapons (without flag state approval) and security guards.

To emphasise upon the PMSCs this gravity, previous offences committed by AdvanFort are listed below.

1. It was found that same AdvanFort was operating a floating armoury closer to Sri Lankan waters and there had been Sri Lankan Navy checks on this matter a year back and questioned them on suspicious grounds. Subsequently they were ask to leave Sri Lankan waters.

2. AdvanFort operated a vessel called “MV Seapole One” tried to enter into Maldivian waters by deceiving the Maldivian Authorities stating that it was a cargo ship and needed some repairs on its hull. However, upon inspection Maldivian Authorities found that “MV Seapole One” was neither a cargo ship nor it needed any repairs to its hull. “MV Seapole One” had 2-0 ‘browning’ which generally are not used by maritime companies, for which documentary proof is available.

3. It was about few months back AdvanFort disembarked unarmed sea marshals in Galle and when Sri Lankan Authorities questioned them about the location of the weapons they could not provide a convincing answer. During questioning of sea marshals, they indicated that their weapons were handed over to a small boat at sea. They were investigated by the Criminal Investigation Department (CID) of Sri Lanka Police and later released. This incident was informed to the Embassy of United States in Sri Lanka. Subsequently, AGMS received a letter from AdvanFort, apologising to the incident.

4. Recently, about few months back vessel “MV Ohio” quoted they were a floating armoury and requested bunkering from a Shipping Agent in Sri Lanka. This matter was referred to us by the respective Shipping Agent in Colombo and asked for permission from Ministry of Defence(MOD) for bunkering. MOD issued a Letter of Authority for the bunkering of the vessel. Having received the authorization from the MOD the vessel did not turn up for bunkering which prompted to develop suspicion over this issue.

5. It was then we made inquiries from the local agent of the said vessel and found that the vessel belong to AdvanFort, but never knew more details of the vessel and its activities. This promoted us to suspect their motive of securing MOD authorization for bunkering and later not showing up for same. We then requested for the details of the owner of AdvanFort and received Mr. Ahmed Farajallah’s contact details. Repeated attempts to get connected to Mr. Farajallah were in vain. Later through our intelligence it was found that AdvanFort was operating an undeclared floating armoury off the coast Galle (Sri Lanka) and had conducted approximately 25 embarkation / disembarkation operations from our legitimate floating armoury “MV Mahanuwara”. Subsequently this undeclared floating armoury belonging to AdvanFort was arrested by the Indian Navy.

6. With the said undeclared floating armoury operations of AdvanFort off the coast Galle, we have reasonable doubts about the legality of their weapons and the parties with whom they had their dealings with. We had a reasonable doubt about the legality of AdvanFort weapons, and did not know whether weapons were obtained from subversive elements.

7. The judgment (For the Criminal Case) against AdvanFort for the offence “Aiding and abetting the making of a false statement during the acquisition of firearms” by United States District Courtof Eastern District of Virginia on 08th March 2013 and 05th September 2013 respectively, stern warning had been issued to AdvanFort not to involve in such offences in future. We also found that they were placed on supervised probation for a term of “Two Years”, and they should not leave the judicial district without the permission of the court. Further they should notify courts any changes in employment and are not supposed to possess or acquire firearms in the United States.

8. When we analyze all above incidents and the USA Court order, we are extremely doubtful of the operational behaviour of AdvanFort Company (now AdvanFort International, Inc; a Delaware Company) in this region.

Please be informed that henceforth, we will not permit any PMSCs to disembark AdvanFort weapons / personnel to any of the AGMS Floating Armouries.

As AdvanFort is blacklisted is Sri Lanka, any weapons / personnel of this company arriving in Sri Lanka will be arrested/ confiscated and necessary legal action will be initiated.

We have informed the Embassy of the USA in Sri Lanka about the illegal activities of AdvanFort. It is found that AdvanFort is using the good name of USA for their advantages. Also, it is pertinent to mention that USA Government has not issued any letter/document to AdvanFort to engage in floating armoury operations in Indian Ocean.

PMSCs are informed not to get carried away by false information circulated by AdvanFort with regard to safety of Seafarersin Sri Lankan Waters, which is secure where Maritime Operations are carried out at present with 100 % safety.

Sri Lanka Navy has also issued a statement on 18th November 2013, refuting this false information circulated by AdvanFort.

Pas de libération sous caution ?

Le procureur du Tamil Nadu, Shanmuga Velayutham, a, en effet, recommandé, vendredi (14 mars), de rejeter la demande du capitaine (Dudinik Valentyn) et des 34 autres personnes qui demandaient leur libération sous caution. « Si le tribunal leur accorde la liberté sous caution, (les enquêteurs) auront à faire face à des difficultés pour s’assurer de leur présence (au procès) » a-t-il déclaré ainsi que le relate The Times of India.

“Q” branch may take over detained vessel probe.

Owner of the vessel in question, the Seaman Guard Ohio, pled guilty to “Aiding and Abetting the Making of a False Statement During the Acquisition of Firearms,” which is a felony under U.S. law.

With the investigation into the detention of the foreign vessel ‘Seaman Guard Ohio’ for having carried arms in Indian waters continuing on Tuesday, there were indications that the probe may be handed over to the ‘Q’ Branch-CID of the Tamil Nadu police.

According to reliable sources, the Tamil Nadu Coastal Security Group, which has been in charge of the investigation so far, is likely to hand over the probe to the Q Branch, which specialises in cases relating to armed groups and having security implications.

A crew of ten men including eight Ukrainians and two Indians and 25 armed guards including foreign nationals of British and Estonian origin on board the U.S. based vessel was intercepted by Indian Coast Guard personnel and escorted to Tuticorin coast on Saturday.

Tuticorin District Collector M. Ravikumar inspected the vessel in detention at the V.O. Chidambaranar Port here on Monday and interacted with the crew.

He said inspections were made for 45 minutes on board the vessel. The Collector said he had sought a report from the investigation agencies. Highly placed sources said it was a long process of investigation involving multiple agencies.

An armed ship operated by a US maritime security company AdvanFort, was detained last Friday

“AdvanFort was involved in at least one prior felony relating to the possession of weapons without permits”

According to a popular maritime security website, gcaptain.com, AdvanFort’s guilty plea and subsequent forfeiture of weapons came after an “independent contractor who promised [AdvanFort] he could obtain the needed weapons

Seaman Guard Ohio was an “Operator Supported Vessel” which was privately owned [by Farajallahs] and in that regard different [on paper] from what is usually referred to as a “floating armoury.”

Anti-Piracy Guards Claim Marsec Company Left Them Defenseless in Hazardous Waters

A private military contracting firm has stirred up a storm for Estonian soldiers-for-hire, allegedly swindling them out of thousands of euros and arming security guards with World War II era guns on dangerous missions along the coast of northern Africa.

EDITOR’S NOTE (August 2013): This story was originally aired on Pealtnägija, a well-regarded Estonian-language investigative journalism program. ERR has no reason to question the integrity of the sources quoted in the story. However, Advanfort maintains it is the target of a smear campaign by competitors, a claim that is also borne out by the disproportionately large number of spam-type comments this 2011 story drew. Advanfort guards were armed with WWII German carbines. “It was shameful boarding the ship with those guns and the sailors also wondered what we were doing – we might as well have been armed with bows and arrows,”

Upon boarding, the four men were given nothing more than two firearms that lacked sights to defend the ship from pirate attacks. The team was forced to use desperate if imaginative tactics, covering the boat with barbed wire and booby traps, and even building human dummies armed with fake firearms.

Advanfort has on some occasions put Estonians aboard ships without arming them at all. Another problem is that the weapons provided lack the necessary legal documents.

Rainer and Almar, it can be assumed, got lucky on their first two-week trip because, in several instances, they listened in on radio calls for help from other boats that had been hijacked by pirates in the same waters.
